1. Introduction

1.1 These Terms & Conditions govern the use of services provided by MyDataSIMs and apply to both B2C (direct-to-consumer) and B2B (business-to-business) transactions. By using our services, you agree to these terms.

1.2 The Agreement comprises five sections:

  • Services

  • Equipment

  • Reselling

  • General

  • Rate Card (available on request)

2. Services

2.1 This Agreement starts when we accept your service request and open an account in your name.

2.2 We will connect you to the services as soon as possible.

2.3 The Agreement continues until terminated by you in writing.

3. SIM Cards

3.1 Terms for SIM Cards:

  • Contact us for a replacement if a SIM Card is lost, stolen, or damaged. A replacement fee may apply.

  • We own the SIM Card and license it to you.

  • We may recall any SIM Card to enhance or maintain service quality.

4. Service Network and Access

4.1 SIM Cards are for data use only and cannot contact emergency services.

4.2 Service availability may be affected by external factors such as weather, network maintenance, or location.

4.3 Report any network disruptions via a fault ticket. We will investigate and resolve the issue as quickly as possible.

5. Use of Services

5.1 Conditions for service use:

  • Do not use services for unlawful, immoral, or improper activities.

  • Services must not be used to make offensive or nuisance communications.

  • Only use equipment authorized for use with the network.

  • Follow all relevant laws and rules.

  • Do not use services to infringe on intellectual property rights or privacy.

  • Provide accurate information when requested.

  • Follow reasonable instructions from us.

  • Do not use services for fraudulent purposes.

  • Do not resell services without our written consent.

  • Do not damage or risk the network, or abuse our staff.

5.2 Our service partners and available service areas may change.

6. Payment

6.1 Charges are set out in our Rate Card.

6.2 VAT is charged as per the Rate Card.

6.3 You must pre-pay for services. Charges are deducted from your account credits.

6.4 We do not refund account credits.

7. Charges and Liability

7.1 You are responsible for all charges on your account.

7.2 You are liable for charges incurred until you report a lost or stolen SIM Card.

7.3 By entering this Agreement, you authorize end users on your account to incur charges without prior permission.

8. Suspension, Disconnection, and Termination

8.1 We may suspend services without warning for network maintenance.

8.2 We may suspend or terminate services if you breach this Agreement, fail to pay bills, or we suspect fraudulent use.

8.3 You must pay all charges during suspension or disconnection unless we decide otherwise.

9. Changes to Charges and Services

9.1 We can change, increase the price of, or withdraw services with 7 days' written notice.

10. Termination Rights

10.1 You can terminate this Agreement with 7 days' notice. For agreed packages or tariffs, a full calendar month’s notice is required.

10.2 A cancellation charge applies if you terminate within the minimum term, calculated based on the remaining balance of any minimum spend.

11. Internet Access

11.1 You are responsible for any content transmitted via internet access.

11.2 Ensure your equipment is compatible and secure.

12. Equipment

12.1 We collect equipment details and network data.

12.2 You need compatible equipment to access some services.

13. Reselling

13.1 If permitted, you may resell services to third parties, complying with our requirements.

13.2 We retain intellectual property rights and may supervise your reselling activities.

14. General

14.1 You need our consent to transfer your rights under this Agreement.

14.2 Inform us immediately of any change in your contact details.

14.3 Notices must be sent to our registered address.

14.4 This Agreement does not benefit third parties.

14.5 English law applies to this Agreement.

14.6 If any part of this Agreement is not legally effective, the remainder remains effective.

14.7 This Agreement is the entire agreement between you and us.

15. Your Information

15.1 Provide true, accurate, and complete information.

15.2 We will notify relevant authorities and affected users in case of a data breach.
